2.2. Language of the contract

- Act CVIII of 2001 on certain questions relating to electronic commerce services (Ekertv. – Hungarian E-Commerce Act 2001/CVIII),

2.4. Acceptance of these Terms
When registering for or first using the Brik service, the User expressly accepts these Terms – by checking a separate checkbox. The service cannot be used without accepting these Terms.
2.5. Amendment of these Terms
The Service Provider reserves the right to unilaterally amend these Terms. The Service Provider must inform the User of amendments by e-mail or via the Service interface at least 15 days before they take effect. If the User does not accept the amendments, they may terminate the contract on the date the amendments take effect.
3. DESCRIPTION OF THE SERVICE
3.1. The Brik service
Brik is a web-based decision-support, calculation software service (SaaS) that helps prepare Hungarian real estate market investment decisions. The Service includes the following main features:
- real estate investment calculator (gross and net yield, total return – rental yield plus estimated appreciation –, cap rate, cash flow, payback period, investment score),
- saving and comparing properties,
- PDF export (Pro plan),
- incorporating public market data (e.g. KSH inflation data, MNB reference rate) in calculations,
- investment comparison table with publicly available market reference data (government bond yields, funds, stock indices).
Using the calculator (running calculations) requires a free account. Unregistered visitors can see the calculator input form, but no calculation runs. Full analysis (cash flow, investment score, Otthon Start eligibility check – a Hungarian government-backed home purchase support programme, saving) and Pro features are available according to the relevant plan. The investment comparison table (market reference data) is available in part or in full depending on the User's status – see the "Investment Comparison Feature" section below.
Calculator inputs also allow a split for purchase-side costs (transfer tax and other purchase costs) and for monthly rental-side owner costs (monthly common charges and monthly utilities).
Investment Comparison Feature
The Brik calculator compares real estate investment results with publicly available market reference data (government bond yields, average returns of investment funds, stock indices). The "This property" row shows the total expected return (rental yield plus the User's estimated annual appreciation) so it can be compared with the total returns of reference investments. Appreciation is an estimate (defaulting to KSH inflation data) and is only realized if the property is sold.
The Service also displays location-based market reference data (average price per m², rent, and 5-year appreciation trend for a selected Budapest district or city, plus comparison with the User's inputs). This data comes from KSH STADAT housing market statistics, is for informational purposes only, and does not constitute investment or real estate advice.
This comparison is for informational purposes only and does not constitute investment advice within the meaning of applicable financial services legislation. Brik does not hold an investment services license and does not provide such services.
Reference data is updated monthly. Appreciation and past returns are estimates and do not guarantee future performance. While the Service Provider strives for accuracy, no liability is accepted for any inaccuracies. All investment decisions are solely the responsibility of the User.
Visibility of the market reference comparison table:
| User status | Available reference rows |
|---|---|
| Unregistered visitor | Not shown (calculation requires registration) |
| Free registered user | All 7 reference rows; the investment score in the "Note" column is available with Pro |
| Brik Pro subscriber | All 7 reference rows; investment score and full Note column |
"Compare saved properties" in the table in section 3.2 is not the same as the market reference table above: it refers to side-by-side analysis of properties saved by the User and is available only with Pro.
Tax calculations
The Brik calculator models Hungarian private landlord tax rules to estimate net rental yield after tax. It shows an approximate tax burden based on 15% personal income tax (SZJA) and the selected cost accounting method (10% flat cost ratio or itemized deductions).
This is for informational purposes only and does not constitute tax advice under Hungarian tax legislation (including the Personal Income Tax Act, Act CXVII of 1995). Consult an accountant or tax adviser before making specific tax decisions.
Any transfer tax estimate shown by Brik (property transfer tax) is also for informational purposes only; the exact tax amount depends on individual circumstances (e.g. reductions, exemptions, swap transactions), therefore it does not constitute tax advice.
Brik is not a licensed tax adviser and does not provide tax advisory services.
3.2. Plans and features
| Feature | Free | Brik Pro |
|---|---|---|
| Calculator (calculations) | unlimited | unlimited |
| Saved properties | 1 (overwritten) | unlimited |
| Detailed score (0–100) | ❌ | ✅ |
| Compare saved properties | ❌ | ✅ |
| PDF export | ❌ | ✅ |
The Service Provider reserves the right to modify plan contents, add new features, or discontinue existing features. The Service Provider will inform the User of changes by e-mail or via the Service interface.
3.3. Nature and limitations of the service – IMPORTANT!
The Brik service is for informational purposes only and is a decision-support tool. The Service does NOT constitute in any form:
- investment advice,
- financial advice,
- tax advice,
- legal advice,
- property valuation,
- creditworthiness assessment.
The User may make decisions based on calculation results generated by the Service at their own responsibility. For specific financial, legal, tax or investment questions, the User should seek advice from a qualified professional (e.g. lawyer, accountant, investment specialist, property valuer).
Calculations are based on input data provided by the User and public market data (e.g. KSH, MNB). The Service Provider does not warrant the accuracy of market data or that calculation results match actual market conditions.
The Otthon Start eligibility pre-screening performed by Brik does not replace the bank's official credit assessment. Programme conditions may change from time to time; final eligibility must be confirmed with the chosen bank.
3.4. Technical requirements
To use the Service, the User needs:
Device:
- desktop computer, laptop, tablet or smartphone (iOS 14+ / Android 9+ or newer operating system)
Software:

Network:
- stable broadband internet connection (at least 1 Mbps).
Other:

The Service Provider strives to ensure accessible use of the Service, but does not guarantee proper operation in outdated or unsupported browsers.
3.5. Technical environment of the Service (Service Provider side)
Brik operates on the following third-party hosted services:
- Frontend hosting: Vercel Inc. (EU region: Frankfurt)

- Invoicing: Billingo Zrt. (Hungary)
- E-mail hosting (info@brik.hu): Zoho Corporation B.V. (Netherlands)
- Marketing e-mail (opt-in): Klaviyo, Inc. (USA)
The Service Provider's responsibility extends to operating its own codebase and Service configuration; the Service Provider does not assume direct liability for outages and errors caused by third-party providers.
4. REGISTRATION AND FORMATION OF THE CONTRACT
4.1. Registration
Using the calculator (running calculations) requires a free account. Unregistered visitors can see the input form, but no calculation runs. Pro features (investment score, unlimited saves, comparison, PDF) are available according to the relevant plan. During registration, the User must provide accurate data. By registering, the User declares that they have reached the age of 16 and are not restricted in legal capacity.
4.2. Formation of the contract
The contract between the User and the Service Provider is formed electronically, at a distance, in Hungarian.
For free use: upon successful confirmation of registration.
For Brik Pro subscription: upon confirmation of successful payment by the User. The Service Provider confirms formation of the contract to the User electronically (e-mail) within 48 hours.
4.3. Technical steps of contracting
- The User registers on the Service interface (e-mail + password);
- confirms their e-mail address by clicking the link in an automatic confirmation e-mail;
- (Pro) selects the Brik Pro plan (one-time fee, lifetime access);

- the User receives confirmation of successful payment.
4.4. Correction of input errors
Before finalising the order, the User may review and modify the data they provided. If the User provides incorrect data, they may notify the Service Provider by e-mail (info@brik.hu), which the Service Provider will correct promptly, but no later than 48 hours from receipt.
4.5. Filing

D) All contractual communication is electronic, in Hungarian. The User must regularly check the e-mail address they provided; notifications sent by the Service Provider are deemed delivered on the 3rd business day after sending.
5. FEES, PAYMENT TERMS, INVOICING
5.1. Pricing
The Brik Pro fee is a one-time payment of 5,990 Ft for lifetime access. The price is small business VAT exempt – it does not include VAT.
Users who subscribed earlier under the monthly model keep their existing 2,990 Ft / month subscription terms until they cancel.
The Service Provider reserves the right to change fees. The Service Provider must inform the User of fee changes at least 15 days before they take effect. Fee changes do not affect already paid subscription periods.
5.2. Payment methods
Fees may be paid exclusively online by bank card via Stripe Payments Europe, Limited. Accepted card types: Visa, Mastercard, Maestro, American Express. The Service Provider does not store bank card data; those are handled exclusively by Stripe under PCI DSS Level 1 compliance. Details: https://stripe.com/privacy
Providing billing data (billing address) on the Stripe Checkout interface is mandatory. The User's data protection rights and processing details are set out in Privacy Policy Section 4.3.
5.3. Access duration
Brik Pro purchased under the current offer provides lifetime access. This access does not renew automatically and has no expiry date.
Users who subscribed earlier under the monthly model keep their existing recurring subscription terms until cancellation, including automatic renewal and related subscription management options on the Service interface.
Lifetime access purchased under the current offer does not require cancellation. For existing monthly subscribers, cancellation rules remain as set out in Sections 5.5 and 6.6.
5.4. Invoicing
After every successful payment and upon performance, the Service Provider issues an electronic invoice via the Billingo Zrt. invoicing system, sent to the e-mail address provided by the User and made available retrospectively on the Service interface.
By accepting these Terms, the User expressly consents to electronic invoice issuance (the invoice is valid in electronic form under Act CXXVII of 2007 on VAT).
The Service Provider fulfils data reporting obligations to the NAV Online Invoice system for every invoice issued under legal obligation. The Service Provider must retain issued invoices for 8 years under Section 169(1) of Act C of 2000 on accounting.
5.5. Late or failed payment (existing monthly subscribers)
This Section 5.5 applies only to Users who subscribed under the earlier monthly Brik Pro model.
On failed automatic debit, the Service Provider (via Stripe) automatically retries 3 times at intervals of a few days. Meanwhile, the Service Provider informs the User by e-mail of the failure and provides a grace period of at least 7 days to update the payment method. If payment is not completed during the grace period, the Service Provider may automatically suspend Pro access and downgrade the User to the Free plan.
6. RIGHT OF WITHDRAWAL AND TERMINATION
6.1. Consumer's right of withdrawal/termination without reason
A User qualifying as a consumer (a natural person acting outside their trade, profession or business activity) has a right of termination without reason within 14 days of concluding the contract under Government Decree 45/2014 (II. 26.).
6.2. IMPORTANT: loss of withdrawal right for digital services
Under Section 29(1)(a) and (m) of Government Decree 45/2014 (II. 26.), the consumer may not exercise the right of withdrawal/termination for a digital service not supplied on a tangible medium where the Service Provider began performance with the consumer's express prior consent and the consumer simultaneously declared that they acknowledge losing the right of termination once performance has begun.
When ordering a Brik Pro subscription, before finalising payment, the User must check a separate checkbox stating that they:
- expressly request that the Service Provider begin performance (activation of Pro features) before the 14-day withdrawal period expires, and
- expressly acknowledge that they thereby lose their right of termination once the service is fully performed.
If this declaration is not made, Pro features will not be activated.
6.3. How to exercise withdrawal right if still available
If the User orders the Pro service but does not make the declaration under Section 6.2, or performance has not yet begun, they may exercise the 14-day withdrawal right as follows:
- by e-mail: info@brik.hu,
- by post: 1134 Budapest, Lőportár utca 20/A.
The declaration must include the User's name, e-mail address and clearly express the intention to terminate. The withdrawal declaration template in Annex 1 may also be used.
6.4. Service Provider obligations on termination
If the consumer still has the right of termination without reason, the Service Provider must refund fees paid by the User within 14 days of receipt of the consumer's declaration, using the same payment method the User used.
6.5. Termination of free service
The User may terminate the free plan at any time, without reason, by deleting their account (Profile → Delete account) or by e-mail to the Service Provider.
6.6. Ordinary termination – Brik Pro access and existing monthly subscriptions
Brik Pro lifetime access purchased under the current offer does not require cancellation and remains available without renewal or expiry.
Users who subscribed earlier under the monthly model may still cancel their Brik Pro subscription at any time, without reason, on the Service interface ("Profile" → "Manage subscription"), even where performance has already begun. Cancellation takes effect at the start of the next billing period; fees for the already paid period are not refunded; the User may use the service until the end of the paid period.
7. WARRANTY FOR DEFECTS, PRODUCT WARRANTY
7.1. Warranty for defects (Ptk. Section 6:159)
If the Service Provider performs defectively, the User may enforce a warranty claim against the Service Provider. In a consumer contract, the User may enforce warranty claims within 2 years of performance.
The User may, at their choice:
- request repair or replacement (correction of the service defect), or
- request proportionate fee reduction, or – if repair/replacement is not possible or imposes disproportionate burden – withdraw from the contract.
For defects arising within 1 year of performance, it is presumed that the defect existed at performance; the Service Provider may rebut this presumption.
7.2. Product warranty
As Brik is a service, not a movable product, product warranty claims cannot be enforced.
7.3. Guarantee
The Service is a digital service not subject to mandatory guarantee.
7.4. Digital service defects – EU warranty rights
Under EU rules, the User is entitled to at least 2 years of warranty protection for digital service defects. The Service Provider must ensure continuous availability, updates and reasonable-time correction of defects.
8. SERVICE AVAILABILITY, MAINTENANCE
8.1. Availability
The Service Provider strives for over 99% annual availability, but as the Service runs on third-party (Vercel, Supabase) infrastructure, the Service Provider does not commit to a mandatory SLA.
8.2. Planned maintenance
The Service Provider will inform the User of planned maintenance at least 24 hours in advance (by e-mail or on the interface). Brief outages due to maintenance do not constitute breach of contract.
8.3. Force majeure
The Service Provider is not liable for Service outages caused by events beyond its control, i.e. force majeure – e.g. third-party provider (Vercel, Supabase, Stripe, Billingo, Zoho) outage, cyberattack, power failure, natural disaster.
9. LIABILITY, LIMITATION OF LIABILITY
9.1. Limitation of Service Provider liability
Within applicable law and without affecting consumer rights, the Service Provider's liability extends to:
- contractual provision of the Service,
- damage up to the amount of fees paid by the User.
The Service Provider does not accept liability in particular for:
- investment, financial, legal or tax decisions made by the User based on Service results and their consequences;
- lost profit, indirect or consequential damage;
- calculation results based on incorrect input data provided by the User;
- accuracy and timeliness of third-party market data (e.g. KSH, MNB, property portals);
- damage from loss or compromise of the User's password or account.
9.2. Preservation of consumer rights
The liability limitation in Section 9.1 does not affect statutory consumer rights, in particular warranty and statutory compensation claims. These Terms do not exclude liability that cannot be limited by law.
9.3. User liability
The User undertakes to:
- use the Service as intended and in compliance with applicable law;
- provide accurate data during registration;
- adequately protect their account and access credentials and not share them with third parties;
- not attempt to circumvent the Service technically or abuse it in any way;
- not replicate, copy or commercially exploit Service content without the Service Provider's prior written consent.
10. INTELLECTUAL PROPERTY
The Brik name, logo, trademarks, application source code, calculation models, user interface and all content are the exclusive intellectual property of the Service Provider. Within the Service, the User acquires only a personal, non-transferable, non-exclusive right of use for the duration of the subscription.
Unauthorised copying, distribution, modification, reverse engineering or commercial use of any Service element is prohibited and may have legal consequences.
11. DATA PROCESSING
The Service Provider processes the User's personal data in accordance with the GDPR and Infotv. Detailed data processing terms are set out in the Privacy Policy, available at /privacy.

By accepting these Terms, the User declares that they have also accepted the Privacy Policy via a separate checkbox.
